Texas allows employers to opt out of (non-subscribe to) the workers comp system. Occupational Accident products are an alternative means to insure occupational risk.

Kilpatrick Companies pioneered the Non-Subscription market in Texas. The Occupational Accident division is led by Jackie Kilpatrick, who designed and launched the first Combined Single Limit product in the state of Texas. As a pioneer, Jackie initially sold group voluntary accident products to handle worksite injuries. As the demand grew, she and a small group of friends authored a more robust accident program with higher limits and longer benefit periods. Beginning with the initial Fidelity Security program, ERISA documents were introduced providing extra layers of protection, legal indemnity was added, the state of Texas introduced an official opt-out process, and more carriers became involved. As the niche market expanded across the entire state, sophisticated products and options were introduced allowing any size employer with any degree of hazard to be a candidate.

Today, the company represents the majority of the available markets. Primary and excess plans with and without legal are available. Most carriers will write down to 1 life depending on class and industry. The availability of products including legal liability coverage and underwriting requirements vary by carrier and exposure.
